American Airlines has dropped the Google trademark lawsuit, according to a report that was given by Bloomberg, where both the airline and online company have finally settled the the legal dispute over search ads. Both American Airlines and Google have made the agreement to each pay the legal fees for their own company, but the terms for the settlement are not know by the public.
Almost a year ago, American Airlines filed a legal suit on Google about trademark infringement in the Google AdWords product. American Airlines, in a nut shell, didn’t want the company to allow other advertisers to make bids on the search terms: American Airlines Deal, American Airlines, Free AA Travel Offers, American Airline, AmericanAirlines, AmericanAirlines Com, American Air Lines, americanairlines.com, and www.americanairlines.com. Google made a request to the judge for a dismissal of the case only after just a few months of the suit being filed by American Airlines, but their request was denied rather quickly.
Eric Goldman believes that Google was not making any special allowances to American Airlines in order to block the keyword ads for their trademarks. Goldman says that he personally did some searching of his own on the keywords that the airline disputed against, and while a lot of them did not result in ads from any other 3rd party companies, some of the keywords did return ads. It is very difficult to see which one of the companies actually won the law suit, he added.
